10. Warranty/claims for defects
10.1 The customer must inspect the goods to a reasonable extent immediately upon receipt and report any obvious defects immediately upon discovery. The receipt of notification by us is decisive for compliance with the deadline. Returns can only be made with our consent.
10.2 In the case of timely and justified complaints, the customer may demand subsequent performance. We are entitled to refuse subsequent performance in accordance with statutory provisions. Refusal of subsequent performance, its failure, or its unreasonableness for the customer entitles the customer to withdraw from the contract or to reduce the purchase price. Unless withdrawal is legally excluded, the customer is entitled to withdraw from the contract or to reduce the purchase price only after the expiration of a reasonable deadline set by the customer for subsequent performance, unless setting a deadline is dispensable due to statutory provisions. In the event of withdrawal, the customer is liable for deterioration, loss, and unused benefits not only within the scope of the customer's usual care, but also for any negligent and intentional fault.
10.3 If we are not the manufacturer of the delivered goods, claims for defects can only be asserted against us to the extent that we can assert recourse claims against the sub-supplier.
10.4 We assume no responsibility for public statements and advertising claims relating to our products that were not directly initiated by us.
10.5 In all other respects, the statutory provisions shall apply to the warranty.
10.6 If you are an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), the statutory provisions apply with the following modifications:
Only our own information and the manufacturer's product description are binding for the quality of the goods, but not public praise and statements or other advertising by the manufacturer.
You are obligated to inspect the goods promptly and with due care for any deviations in quality and quantity and to notify us of any obvious defects within 7 days of receipt of the goods. Timely dispatch is sufficient to meet the deadline. This also applies to hidden defects discovered later upon discovery. Failure to inspect and notify defects will void the assertion of warranty claims.
In the event of defects, we will provide warranty at our discretion through repair or replacement (subsequent performance). In the event of repair, we are not obligated to bear the increased costs incurred by transporting the goods to a location other than the place of performance, provided that the transport does not correspond to the intended use of the goods.
If subsequent performance fails twice, you may, at your discretion, demand a reduction in price or withdraw from the contract.
The warranty period is one year from delivery of the goods.
General right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the last goods.
By way of derogation from this, in the case of a contract for the regular delivery of goods over a specified period of time, the cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the first goods.
To exercise your right of withdrawal, you must inform us (Gut und besser GmbH, Markelstr. 2, 12163 Berlin, Germany, email: hello@reoat.de ) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.
To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.
Consequences of revocation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract to

to return or hand over the goods. This deadline is met if you send the goods before the expiry of the fourteen-day period.
You shall bear the direct costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.
